Agreement to Terms

These Terms of Use constitute an agreement made between you, whether personally or on behalf of an entity (“you”) and Prebuilt (“Prebuilt”, “us”, “we”), concerning your access to and use of the website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Terms and Conditions or documents that may be posted on the Site from time to time are expressly incorporated by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. PRODUCTS

We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change. We reserve the right to modify products to cover a missing product and that will be let aware to the necessary targets.

USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. Your details that you store willingly on your account should also be confidential, we try to make your data secure at all measures however the security can not be guaranteed when the user is irresponsible with his/her actions.

USER REPRESENTATIONS

If any malicious activity has been caught on by us we have the right to suspend or terminate your account.

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the UK, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

WARRANTY

We give Warranty to all our clients to ensure that if anything goes wrong that is not the client’s fault we are obliged to review the PC and inspect the situation. However we can alter our choice to reject any Warranty claims shall any discretion by Prebuilt come forth. We do abide by the consumer rights and allow claims but Prebuilt has the sole right to cancel anybody’s request by which is deemed justifiable. PURCHASES AND PAYMENT

Through our payment gateway Stripe we accept the following forms of payment:

• Visa

• Mastercard

• Third Party Pay (i.e Google Pay, Apple Pay)

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, we do not hold any responsibility for any mistyping of any information and the user takes full responsibility of entering the information. There might be a flat shipping fee and there may be VAT added on to the price. We may change prices at any time. All payments shall be in British Pounds.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorise us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

SHIPPING

Product processing usually takes around 3-5 business days to factor in all the work that we do. The goods you order will be delivered to the address you give when you place your order. If delivery cannot be made to your address for reasons under the Supplier's control the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery. If you deliberately fail to take delivery of the goods (otherwise than by reason of circumstances under control of the Supplier) then without prejudice to any other right or remedy available to the Supplier, the Supplier may:

• store the goods until actual delivery and charge you for justified costs (including insurance) of storage; or

• sell the goods at the best readily price and (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods.

If you fail to take delivery because you have cancelled your contract under the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 the Supplier shall refund or re-credit you within 14 days for any sum that has been paid by you or debited from your credit card for the goods, less any expenses incurred for failed delivery. Time for delivery shall not be of the essence. The goods may be delivered by the Supplier in advance of the quoted delivery date. You shall report any damage or shortage to the Supplier in writing within 2 working days of delivery. Provided prompt notice of transit damage or loss is given and provided it is proved to the Supplier’s satisfaction that such damage occurred in transit, the Supplier will refund, repair or replace such goods free of charge to you.

APPLICABLE LAW

These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
